Chapter 7

Chapter 7 is liquidation bankruptcy. Under personal bankruptcy provisions a person may keep all exempt property and discharge all debt, except child support is never eliminated and student loans are eliminated only in hardship situations. It will automatically stop creditor harassment. If you are a business filing Chapter 7 you can discharge most debts owed by the business. If you are one of the few who do not qualify for Chapter 7 you may file Chapter 13.

Chapter 13

Chapter 13 is generally advised for higher income individuals. Chapter 13 is perhaps the best way to prevent a home or other assets from being taken or liquidated by creditors. The homestead exemption is valued up to $500,000. Filing for Chapter 13 can stop foreclosure of your home or repossession of your vehicle. The court forces creditors to work out payment plans with the debtor. Plans stop interest and penalties and set a payback period of three to five years. Chapter 13 can be a solution to income tax issues as well. Chapter 13 also allows child support arrearages to be repaid.

Chapter 11

Chapter 11 bankruptcy is business reorganization. Businesses are allowed to discharge debt they cannot pay or reorganize to provide business success, if approved by the Court.
